Auto Title Question...

Here's the Reader's Digest version...

1998 Ford Escort showing as paid on credit report through Chapter 13 BK that was dismissed.

Found out earlier this year, car was not paid off, has balance of about 5000.00.

Want to get title to the car, but Ford Motor Credit says "nope, but if you want to settle we can do that and release the title".

Should I settle or just leave things as is...

lisajt66, yes the 13 was dismissed because the payment plan was not completed.

I thought the car had been paid off. Had I known that it wasn't, I would have included it in my Chapter 7 that I filed and was discharged about 2 years ago.

I don't have any problems with coming up with a settlement amount with Ford Motor Credit. When I spoke with them over the summer, they were ver polite.

I'll probably just request a settlement amount of about 1,000.00 and see if they'll go for that.

Had you included the car in the CH 13 and reaffirmed the loan? Did monies paid to the trustee before dismissal include any payments he forwarded to Ford? If it was and he did is the balance of the loan then $5000 after your payments?

IMO I doubt Ford will settle a $5000 balance for $1000 and release the title.
