rabbit
The credit card debt is all mine. The accummulation of late fees, interet and court costs have brought the amt owed to over 42,000. From an original of 23,565, so it has nearly doubled in 3 1/2 years. The cars are in my wifes name, the furniture, etc,. is joint property and from what i've read, it cannot be taken for a sheriffs sale.what would you think if transfered everything into my wifes name; house, furniture, etc.? jq26
I think that would look like fraud. You borrowed money, tranferred assets out of your name, then want to file BK7 to extinguish the debt. No court could be happy about that. But I am not an attorney. Not yet anyway. I'd seek one out before initiating your plan.
keith
Highly illegal! Better go to plan B, (if that was plan A)
bingo
You live in Fl. The equity in your home is exempt anyway. Why do this the hard way? Just file.
LadynRed
The cars are in my wifes name, the furniture, etc,. is joint property and from what i've read, it cannot be taken for a sheriffs sale.Wrong, tenancy by entirety only goes to an ESTATE, or the real estate, it does not apply to personal property. If you can't exempt it all, it's fair game.
