LeroyM Posted November 6, 2007 Report Share Posted November 6, 2007 I went to court in Texas the last week of July. I was beinged sued by a CA. When my court case # was called the Plantiffs were not present. So i made a motion to Dismiss the case. The judge sitting in dismissed the case an stated i was free to go. Three weeks later i get a letter stating i had a judgement against me. I called the Civil court clerk she stated there was two judgments given. The civil clerk stated the plantiffs evidently came to court later and the judge ruled against me. I saw the attorney for the Plantiff sitting in court but when the case number was called he never came forward. Is this legal? Is there a time frame for reinstating a case? It's obvious the CA did not have the necessary documents to fight the case. PLEASE HELP I FEEL HOPELESS. Link to comment Share on other sites More sharing options...

If so I would include in my motion to vacate the judgement that Attorney was present and later came back after was dismissed. is that legal? Would like the opprortunity to be heard by the court and have production of documents as well. It sucks because the ca attorney is grimey but you fight them. I'm sure it was done because he lacked proof. good luck. also look up your state and federal court rules and see if you can find the law that supports your claim submit with motion to vacate.
