Van Rue CC-Wage Garnishment/Judgements

Hello all, quick question. Gov't sold/handed over my defaulted student loan to Van Rue Credit Corp. They've been harrassing me at work since 10/1 and recently called HR to verify my employment.

HR told me they're probably about to enter a judgement against me and garnish my wages.

What should I do? Just moved to DE, work in PA. Which laws apply?

Thanks for your reply. This company has made no other attempts to collect this debt.

I don't believe they have any other info on file for me exept my employers phone number/address. They don't have a home address or telephone number.

Should I send a DV letter? Should I send a C&D letter to end the harrassing phone calls?

I think you better do a bit more than send a DV, since the following statements are all true:

1. They can garnish your pay simply by sending an Administrative Garnishment order to your employer

2. There is no SOL for the debt

3. There is no SOL for reporting the debt under FCRA

4. They can and probably will ignore FDCPA at will

5. Your tax refunds will be intercepted until this debt is paid.

Have you ever considered either entering into a rehab for this debt or filing for hardship?

You are absolutely right. I called them today and they were pretty pleasant. I tried to come to some sort of terms but they made it seem as if they couldn't stray from a certain figure. Now I have another delima.

This debt is scheduled to come off of my EX CR in Feb '08. Is it worth touching now?
