Served Papers, Now What??

I am new at this , so please bear with me.

Last Friday I was served papers that I was being sued by Palisades Collection, L.L.C. Assignee of AT&T. for a debt from 2004. I have tried to negotiate the debt with Palisades. In Dec. of 2006 I received a letter from Their attorney stating they would agree with the negotiated amount and informed me that if I called her (attorney) number, she gave the number, she would complete the necessary paperwork and send to me. I called the number for 6 consecutive days and left messages that I agree. After the first of the year I forgot to keep calling and did not hear from her or received anything in the mail from them, that is until Friday when I received the summons. I live in Texas and the SOL is 4 years and the four years is up Feb 2008. My question is, in the state of Texas, if and when a judgement is won by the creditor, 1.) can they garnish your bank account or wages or both??.

2.) Can you negotiate after the judgement.

3.) My original debt was for $1800.00 In dDec. 2006, I have in writing they agreed to settle for $900.00 Can I get the judgemen for $900 vs $1800.?

Any comments?

NO they cannot garnish wages you must be in court for that to happen! So dont panic. Are you sure you were serve papers from the courthouse the name of the court should the return address,not the debt company??? First they must sue in the state you reside and the statue of limitation were you live prevail. So if the company hasnt filed a court case in Texas and the court papers delivered to you directly from a Texas Courthouse. Dont panic they are bluffing and counting on you not to know the federal,state debt laws. You say the statue of limitations expires in 2008 that is why they are contacting you!! Dont do anything,dont agree to anything,just keep track of all correspondence. This will all wither away. Now if they do file court case in Texas still dont panic they must validate before starting a court you will tell them that they are violating federal laws by not validating before starting a court case and you will inform the jugde of this and ask the case to be dismissed and it will be!! You are o.k.!!
