First Premier to Arrow to Portfolio Recovery - pass SOL

I have a CO on all reports from First Premier. The last payment date was 11/01 and the reports do correctly reflect that it will drop on 11/08. The SOL in TX is 4 years. This makes the SOL date 11/05.

The account was originally sent to collections with Arrow. This use to show on my reports, as matter of fact, it is on the reports I pulled last year but is no longer on any report.

Portfolio Recovery is now on all reports but shows the client as Arrow with $10 difference in the amount. Portfolio also sent me a letter on 10/14, however, to the wrong address so there was long delay in receipt.

I am disputing the TL with the CRA's but the content and timing of the letters I should send to First Premier and Portfolio have me perplexed. :confused:

Do I send a SOL, kiss my grits, get this off my report letter to Portfolio at the same time I dispute to the CRA? It's obvious they are trying to collect First Premier account and according to the EX report they first reported this on 5/07. That was already passed the SOL. Is that legal?

Then, should I wait on the CRA response before I dispute with the OC or should I dispute with the OC at the same time as well? Also, do I include any SOL information to the OC? It seems irrelevant since it does not have any bearing on the reporting time.

You can send a "kiss my butt since the debt is out of SOL" letter, but they don't have to stop reporting until their time is up (11/08).

It's past the SOL to collect but not for the reporting period. So yes, it's legal for them to report IF they are attempting to collect legally. (That info can be found out by DVing.)

You can dispute directly w/ the OC once you dispute w/ the CRA and get a response.

You're right; mentioning the SOL to the OC has nothing to do w/ the reporting of the TL.

Thanks so much for the info! I tried searching the forums over and over for someone who had both an OC and CA reporting the same debt to see how they approached the situation but I just couldn't find anything.

Also, PR reporting after the SOL was a grey area for me.

So tomorrow morning I will be sending out my disputes to the CRA's. I will wait the 30 days, see what is left, DV the remaining CAs, dispute with the OC. Wait for the notification of receipt (green cards/FedEx confirmations) then send new a dispute to the CRA as the signatures for each arrive item asking for a new investigation. Sounds easy right? :shock:
