Ive just been waiting to try and dispute this until they cant sue me anymore!! THANKS!!!!First of all, the SOL is not going to help in getting it removed from your CR. It can stay there for the 7 years.Second of all, was there a good reason for breaking your lease? If so, this may be the reason they are not coming after you with a court summons, because they may feel they wouldn't win, even so, they can report it to your CR until you do something about it.The major reason rental defaults (for lack of better term) are reported, is because there are many landlords out there who run reports on their potential renters, and an entry like this is their main concern. Most would not rent to you because they would see themselves as the next entry on your credit report, not to mention, some rental agencies (such as the one on your report) know that you would never get a home loan until you paid this off, so they just let it sit there, and if right before the SOL is up, you still haven't paid, they might go for a default judgement to keep it on there another indefinite amount of time, hoping you will want to purchase a home and just pay it to be done with it and get your home.I would say your best bet is to look for a loop hole in your rental agreement/contract.But be prepared, if you were less than helpful when you initially broke the agreement, they might not be so inclined to back off. (Ex: you just moved some where less expensive and told them to shove their rent up their butts, etc)
sashim80
Well, Ive been waiting all this time Ive been repairing things on my credit report for the SOL to go up on this before I touch it. I dont want them to come and try to sue me! I know SOL has nothing to do with them trying to collect. I really want this off! I guess first I would try the dispute, then DV, then PFD, maybe one of those things will work. Its like the only bad thing on hubbys report. REALLY hurting us. THANKS for your help! myscoresawful
again, if you had a good reason for moving, something beyond your control, there might be a way out of this. I was once a leasing agent if you need further advice.
sashim80
Well, the reason we moved...I had just gotten pregnant, and my mother in law, offerered for us to come stay on her property. She has a couple houses so this was a very good deal for us. I doubt this, to them, is a very good reason for moving. Another thing is they had some deal when we moved in 2 months free. Well we moved out on like the 4th month! Yeah, I really doubt they are going to make freinds with me again! So, I cant use the normal dispute process for them? I am planning on buying a house next year, and really need to find some way of getting this reomoved or paid, whatever the best action may be. BTW, these charges are NUTS. Im not exactly sure why but this started at almost $5000, then somehow the balance is only 2800 now??? The only thing Id think we actually owe is the 2months they gave us free, All of the other months we were there were paid. They sent us an itemized bill for the charges when it first happened, I know they are legit, just CRAZZZY fees for breaking the lease and such. Usually, moving for the reason of paying less rent is *not* a good reason in their eyes. If for example you were having complications and needed to live with someone because of it, that might be different, something that is beyond your control. We did have a guy in the service that was called up and sent to Iraq, obviously, he was released from his rental agreement.
sashim80
Well, yes we were having "problems" and Im sure they would be aware of that, since we were late on the months we were there! It was just a mess. I couldnt work as I was sick as heck from being pregnant. I had just been through a divorce and my ex took the car I was using to get back and forth to work in. MESS MESS MESS!!! It was a very stupid move on my part to even try and move to this city! Im glad we got the heck out of there before it got worse!!
Skrangs
Sashim80 ..I would still dispute with CRA and DV with CA. I had TWO apartment debts on my report that were $4000 EACH PLUS the default judgement against me because my silly azz didn't go 2 court (young and dumb?). Both of those JUST fell off of all my CRA's, however they were do to come right around this time anyway. I did manage to get them removed early just by disputing them with CRA. When I DV'd with CA, they actually sent me a copy of the lease I signed!! So I waited 2 months, disputed again with CRA's, and BAM, they're gone. So having been in your shoes, dispute with CRA and DV. There IS a chance they will just come off, MINE DID!!
