I have searched the posts for Asset and noticed thay are a hard sell. For some background, I first saw the CA on my report in Jan 07. I was checking my credit, getting ready to buy a house. And there it was, no letters, no warning, they bought a debt from Provdian from 2002. I immediately DV'd and was sent a screen print from their computer showing OC, amt, etc. I turned around and sent a 2nd request for DV and a screen print from my computer stating that I did not owe anything. No response.I spoke with a manager in their Brandon, FL office in April and I was told they did not have to give me any more back-up information than they had provided.I have been able to get the item removed from all but EQ, but I noticed that they are reporting the DOFD as January 2007. This is re-aging right?I filed a complaint with the BBB in their area tonight, but I am unsure where to go from here. Do I have grounds for suit?Also, I didn't notice the re-aging until after I filed my complaint....I am still learning.Thanks to anyone who can help. MadMonkey Posted November 27, 2007 Report Share Posted November 27, 2007 First, start with the basics. You need to DV the CRA first. Their is a method to the credit repair madness. Read my sticky for newbies, plus the many other excellant ones on this board. Are you familiar with your states SOL?Make sure you completely understand the DOFD, or DOFMD. Do you have absolute proof in your possession as to the last payment you made on this account prior to it going delinquent either partial or in full? If not refer to my sticky!Was the DOFD what the OC reported or what AAC is reporting?Regarding the BBB.Here's a little life lesson. The BBB is not a Govt. Intety. They have no legal rights to tell a company what they can or cannot do.We get calls from there telemarketers every year trying to get us to subscribe. The bottom line is the more you pay them the more apt they are to protect your name.I could go into detail but I won't. Just go to there websight and type in Home Depot, who I might add does not subscribe to the BBB, then look at the ratings for any of there locations. When your done type in Lowes, who do subsrcibe and see what their ratings is.I own a construction company. We have commercial accounts at both places. My guys have explicit instructions that they are only to buy from H.D. first and only from Lowes if H.D. is out or back ordered. Why? Because H.D. does not ask questions of there commrecial customers when they bring back returns. Lowes, its like sitting in front of the board of appeals. Each time I was sent the "this item has been verified that it belongs to you". So I sent another written dispute CMRRR stating I was disputing the Valididty of the debt and requesting back-up informaton, from both the CRA and CA.The longest SOL is 5 years in FL. This would make it out of SOL by 10 months.The DOFD as shown on my CR by CA is 01/2007. However the OC on an older report shows the DOFD as 02/2002.As far as proof is concerned, I do not have the orginal paperwork, (Ex-husband, nasty divorce, alot of bad marks on my credit , etc.) I have requested all of the back-up info, but nothing.I only reported it to the BB, beacuse I read other pots RE Asset and it worked for others. Once you DV your CRA and they say verified. That's it for them. You can hammer them over and over and hope that someone makes the mistake of removing the TL. It happens alot. Companies like Lexington Law rely on this method.However, once they verified then you need to go back to the OC to verify the debt, contracts you signed, signatures, etc...I had a credit card from the early 80's that was one of those mail in cards you used to find in magazines. The OC had been bought and sold at least a dozen times in twenty years. When I DV'd the last know owner of the account, I almost fell over backwards when I got a photo copy in the mail of the original mailed in card, and sure as you know what it had my signature on it. They had me, and at that point the only thing I had going for me was a) the SOL was up and the seven year itch was only months away from going away. .The DOFD is an issue for you. With out a lawyer it's going to be your word against theirs. If at all possible you need to go back to the OC and start requesting records. Banks, etc... If you were married and had joint accounts you should have legal rights to access that info. Warning, though it may cost you money. So be prepaired.If you read my sticky for Newbies one of the things I touch on over and over is record keeping. It's the one thing that will come back and be your best friend. As I have said countless times before try, try, try.... to get those old records. The CA's rely on people not being prepared, or ogrinizied, or have any past history.If you asked me what was the single most thing I had in my corner durning my credit repair history, Recording Keeping would lead the list.RE: BBB. Just do the Home Depot / Lowes test, I think it will answer your question. Believe me most CA are not worried about breaking federal or state laws, why in the world would they worry about the BBB. The FDCPA does not apply to them. The CA however must provide validation to you if you requested it w/in the 1st 30 days of initial communication. If your 1st DV letter to Asset was your initial communication, then they must comply. But as I'm sure you've read, Asset plays hardball. The DOFD as shown on my CR by CA is 01/2007. However the OC on an older report shows the DOFD as 02/2002.The 01/2007 date isn't the DOFD; it should be the date that Asset bought the account. Therefore, it won't be reaging...UNLESS...that date is actually reporting in the Date of First Major Delinquency line on your EQ report. If it is, then yes...you have grounds for a suit.
