Is there a time frame for suing a Creditor?

I have a charge of with Wells Fargo bank and they will not accept payment arrangements other then something ridiculous and I believe they are trying to sue and get a judgement against me. The amount owing is $8000.00, which I have paid on this account for 7 years and remains almost the exact amount borrowed. Anyway, Over the years the have called me three times at work after I sent three seperate letters asking them not to call me at work because they were upsetting me and harrasing me. I have the fax copies and the confirmations that the letter were received each time. My question is - I never knew I could sue them for this violation, I wrote a letter to the FTC and got them in trouble in which I received a letter from WF stating they had "removed" my number and please except their apologies, but is it too late to sue? The last call in this case was 1 of 2007.

The account is now with another CA - any suggestions on how to settle. I can't afford the whole amount and don't trust making payment arrangments to a CA, but I do want to settle because this is one of only 2 items ruining my Credit.

I do not believe that the OC is bound by FDCPA. I also think SOL on these is

1 year. Do a search on this board on RECOVERING ATTORNEY, he has addressed this issue before, and discussed damages under FCRA as well.

Suggestions for settlement. This sounds like it is firmly within the SOL. The only way I know of is to contact them, either yourself, or through an attorney. Make them some kind of offer and see if they take it, counter offer, or whatever. Go from there. I would urge you to keep all communication with them in writing

What makes you think are ready to sue? Have you been served or are you just getting those "pay us or we might take you to court" letters from the CA?

If you'll provide some more details, a time line and what has transpired between you and the CA to this point, you might get more replies and possibly some ideas for dealing with this.
