marinevet
Since I've been served with a "warrant in debt" notice to appear in court in Jan, I know that if I don't appear, they automatically win, right? But what if they don't show? Does that mean I win?
montanatim
If it's a pure no show? Probably,Ask for dismissal with prejudice for wasting the courts time, it's worth a shot.
pointman
It SHOULD be the same for both sides, but courts seem to allow the plaintiffs a little more leeway with missed dockets, especially if they are in there on a regular basis. I'm sure one of the clerks will "remember" that they called in prior to the time of the setting.Call the court clerk and ask for the disposition of the case. And while you're here, edit your profile "location" and let us know where you are... Someone in your area may have the answer based on local knowledge.
