rburns1963
Ok...I need to know where I go from here. I challenged 3 collections accounts on my Experian report 30 days ago as not mine. They replied via email stating the investigation is ongoing and the results will be available on December 18. If is this a violation, should I call and tell them if it is and demand they delete the info since in was not verfied in the 30 day time frame? Also I challenged another account last week as not mine and it came back verified via email yesterday also. Where do I go with this one?
sgip2000
Did you pay for your report or was it your free annual report?
rburns1963
I have Experian's monitoring service. So the answer is I paid Experian for it.
sgip2000
They only have 30 days to investigate then. On day 30, demand they delete anything they have not verified.
PCS
Do you know if they have any way to track if you pull your credit report thru annualcreditreport? I would never send a copy of the credit report to the CRA.

rburns1963
Do I demand via phone call or in writing? I know CCRM is better but I need them off ASAP!
sgip2000
Do I demand via phone call or in writing? I know CCRM is better but I need them off ASAP!Writing is always better. You could prepare the letter now and have it all ready. Or, you could call after the 30 days and try to demand they delete over the phone and then follow up with a letter. blum1176
so let me get this straight then. If the CRA hasnt validated by the 30(or 45 day period) or if the dipute is still labeled as pending, they HAVE to remove it by law? So if I understand above, on day 31 or 46, one should go to the post office with cell phone in hand, send a letter, then call and demand removal? what law would you reference when demanding removal? Did you get your ACR within the past year? I was once told that if you get it, they have 45 days investigate any dispute you send in for the next year. Also if you responded to their form letter, with information, you added 15 more days to the investigation. I would call up EX demand it be deleted, don't back down...see what that gets your. rburns1963
Follow up - I called the bumbs yesterday and demanded the items be removed. She told me they had 15 days, totaling 45 days to complete their invesitgation. I told her I will proceed legally if it isn't removed in 24 hours. We will see what happens when I pull today. rburns1963
Funny you should ask...I did ask that question and she said it was their legal right. I am going to send and ITS letter. Hopefully that will get them to budge. If not I have my documentation and it's off to court.
Amerikaner83
Anytime during your dispute did you dispute anything else with EX? Anything else at all? Maybe you responded to a letter "we need more info from you"?
rburns1963
I thought about that to, but it wasn't one of those "I need more info" letters. I used to get those from TransUnion.

lolah
WHY is EX so damn hard to deal with? Just venting...I know this has been discussed many many times...
rburns1963
That I did do. So you feel that maybe the reason for the entension? I got to say they seem to be the most elusive and trickiest of the Credit agencies.
rburns1963
Seems to me they haven't been sued enough. Equifax by far is the best to work with. Its like they don't care and if you have a fair enough reason they will delete the info.
Amerikaner83
YES.If you dispute something else, even if it's something entirely different than your original dispute, they get the extra 15 days. It's considered "additoinal information from the consumer", wich gives them the extention.
rburns1963
Ok...that explains a lot. Well I will tell you I just checked and one item came off so I am going to wait. The process is working just slow so I have to keep from shooting myself in the foot. Thanks for the info.
blum1176
I have found that to be the most difficult thing in this entire process is the waiting. It just seems erediculopus that in a blink of an eye negative info can be placed on your report, but its like moving mountains getting it removed. well, such is life I guess. Its just pretty agonizing all the waiting.
