I want to know because it has been past 3 weeks since I sent mine and it was signed for. Need to know what to do next to protect my rights.thanks!! If your DV was timely, they can either choose to respond and continue collection or do nothing and cease collection. The FDCPA does say something about you have 30 days from "first contact". In your DV letter, you should point out what that first contact was...send them a copy of the letter you received, or use the "hey, found you on my reports" approach. jasen Posted November 30, 2007 Report Share Posted November 30, 2007 I always wondered that myself. I've often found collections show up on my report, yet never get any dunning from them. I would think "first contact" is bi-directional. Whomever contacts the other first. And that's the way I approach and word DV's and letters to them.But yeah, that's up to the judge to decide.
