so--the CA sent me another person's DV ?..

Okay...this is what happened...

I asked for DV, the CA sent DV with all the statements and my original signature to the credit card company..so I made my offer..

and..they totally ignored my offer and keeps reminding me how much i owe..

yesterday I got an envelope from them...ADDRESSED TO ME, but when I opened it, it was someone else's T-mobile bill.

So what should I do now? Call them to let them know they sent to the wrong person? But does that mean they possibly sent something thats my personal confidential material to someone else?

Well, there are a few different things you could do. What I would do is threaten them with legal action due to them sending you someone elses private information. A direct violation of federal privact laws (hippa). I would negotiate a complete delete of all your collections from them in return for not contacting the actual owner of the info that was sent to you. you have alot of power against them for that. they would be in deep trouble for allowing that info to someone else.

Just my 2 pennies, i may be wrong. through my work i have had to deal with alot of strict hippa laws and know they are very harsh for violators

HIPPA is actually The Health Information Privacy Protection Act. It just deals with medical information and privacy of medical records.

I would call them and find out if they did send your info to someone else. I would also ask what information they were trying to send to you. It sounds like a problem in a mail room with the wrong letters going into the wrong envelope. Call and inform them of the situation. Good luck.

They violated the FDCPA (§ 805(B)) in regards to the other person who's bill you now have. It would be viable action for them to sue for this, but I don't think you can sue for it. You would have to prove that your info was sent to another person.

Is there a phone number or address you could contact the other person with? I bet they'd be interested to know that their old phone bill is floating to random people.
