If you know this debt is out of statute and can prove it, I'd send a stern C&D letter (there is no reason, in my opinion, to "validate" if you know it is your debt AND that it's past SOL and you can prove it if need be).

If the amount of time has past that it can be reported to the bureaus I'd also demend, with them and the bureaus, that they remove th tradeline.

I wouldn't expect much of a "fight" out of them unless they are relly scumm and the debt is substantial. If they know the debt is past SOL and they know you know and can prove it, there isn't much more they can do.

When a CA starts contacting you I would alwasy start the DV process...if not, then you need to decided whether to let them alone or start things up.

Things to consder are....

How much is the debt?

Is it your debt?

How close to SOL is it?

I believe it is best to be proactive in most cases but there are times when it's best to keep the snakes in the closet and let them die of starvation rather than waking them up and getting into an unnecessary fitght you may not win.

MO - They also showed up on my TU, as a late past due account, and as a collection on EQ. I disputed both online and, as of today, TU has DELETED their account. Still waiting on EQ. I believe they may be the successor to a Unifund I blasted away last month!
