skinny
I went to the courthouse today to make copies of documents regarding a Judgement filed against me by Cohen & Slamowitz/ DS . Upon review of the doucments , I observed the answer that was filed , that was supposedly wrriten by me , was a fraudulent document. My name and address are spelled incorrectly and I can prove I was at work......Can I sue ? (or is it at least grounds for a vacate )
Amerikaner83
could quite possibly be able to get it vacated based off of the fraudulent answer by the CA....counterclaim? Possibly.
BMN
Falsified court documents are a big no-no. It goes on all the time, but if you can prove it to the judge, it could be a huge benefit to you. Is it a document that is supposed to have your signature on it? admin
You might want to consult a lawyer on this to maximize your award in court. SOunds like a slam dunk to me and a good lawyer should pounce on your case.
skinny
Yes it was to have my signature on it . BMN
Sounds like a possible forgery case. As Admin said, consult a lawyer. If someone lifted your signature and installed it on a new document, it can get tricky.
skinny
Spoke to legal aid personnel ( NOT LAWYERS) and they advised that forgery and false answers are very common and judges and lawyers in NYC see it as the "par for the course" when it comes to NYC courts. They were not very supportive for persuing an action. Should I some this up as cynical law associates and wait and speak to a lawyer?I also am thinking about contacting BBB regarding Cohen and Slamowitz practices... Any thoughts?
