My question is, since it is null and void will it be removed from my credit report completely. Robert Nashville/Savannah Posted December 4, 2007 Report Share Posted December 4, 2007 I assume you mean the judgment was vacated?If so, the bureaus should eventually reflect that and remove it but you'll have to kepp up on it and dispute if necessary.As to your a potential suit; sure you can probably sue but you would have to specifically identify and be able to substantiate your damages in terms of $$$. You also have to decide if the potential award would be worth the damages and/or whether you are willing to go to the trouble of suing and not winning.You might want to discuss with an attorney who is wiling to give an initial consult for free...it's it worth the money, he'll offer to take the case and should give you an idea of the potential for the case...if he isn't willing to take on the case than it probably isn't worth your time either unless you really just want to take it on. Recovering Attorney Posted December 5, 2007 Report Share Posted December 5, 2007 You should get a certified copy of teh order or stip getting rid of teh judgment and send it to the CRAs yourself. Don't expxect anypne else to do it for you. IN NYS there is no cause of action against a lying process server or the lawyer that employs him. Not sure about your state. billy99 Posted December 6, 2007 Author Report Share Posted December 6, 2007 Yes, it was vacated or has the court told me dismissed, and today I get my report and it is listed as paid. I will get a copy of my court papers and sent them to the CRA As I see it showing as paid means it was vaild, which is wasn't. Link to comment Share on other sites More sharing options...
Grendel_Prime Posted December 6, 2007 Report Share Posted December 6, 2007 Don't send the CRA your court papework, that only serves to show that you indeed had a judgment REGARDLESS if it was dismissed or not.You have to verify with your court house and county register that the Judgment has been vacated, then check the computer yourself at the courthouse. Once you have that IN WRITING then you can dispute with the CRAs as "Not Mine" CMRRR, as they'll attempt to verify and then it'll show up as not there.
