Amerikaner83
You need to go to the FTC's website and get the ID Theft affadavit.

admin
Keep hammering the CRAs if they won't help. If they won't remove the info after you've provided them with proof, you can take them to court. Several people are doing this right now in the court system. Unfortunately, this is the only way to get their attention at times.
divinemadness
thanks!! i will do im wondering how i should word a letter with the proof i have?? can i just simply state its fraud and send a copy of my proof with it? or do i need some elaborate letter? ihave fraud alerts on all 3 bureaus since august when i found out, and security freezes that were for 90 days, but i think i need to reinstate them now its been over 90 days. merkurfan
Your a victim of fruad. you can get all 3 to place a security freeze on your reports for free. Just send a copy of the letter from WU, a copy of the police report and proof of who you are (directions are listed on each CRA's site) CMRRR and they will lock your reports for you. You will have to keep pounding away at the CAs and OC's until they give in.Also, I have found it is easiest to give the cubies one chance to get it right. If they fail to do what is right, I fire off my letters to the cooperate counsel. Oddly, that bunch of people make the cubies jump and do what the law requires. merkurfan
the companies lawyers. send copies of what you sent the first time and a letter saying they basically ignored your requests and are denying you your rights under the FCRA and or FDCPA. The lawyers have a much better grasp on the law, and what must be done.

divinemadness
ive had no prob getting collections deleted. its the charge offs that are PAID. LOL
Methuss
If you have not done so already you should also go to the police station with a copy of the western union letter and fill out an identity theft complaint. Then you send the FTC ID Theft affidavit with a copy of the police report to each creditor involved and to the credit bureaus.Under the FACT Act, they have to remove it from your report permanently and immediately. Further, the creditor is forbidden to sell/transfer the debt to anyone else and must permanently cease all attempts to collect. If you find you are having trouble getting cooperation from any party in doing what the law says they must, then get a lawyer and sue the offender. A woman in Florida recently got a $2.7 million judgment against just one credit bureau for failing to remove IDTheft related items from her report. So lawyers are just drooling for cases showing blatant refusal to follow the law now. Most will take the case on contingency (you pay nothing, they get 40-50% of anything won).
