MrsW
Settlement offer mailed to my old address on Oct 1st 2007. OC:AT&T. $2241.02Disputed with TU - CMRRR - rec'vd Oct 31st 2007. CR - Date opened 10/05Disputed with EX - CMRRR - rec'vd Nov 1st 2007. CR - Date opened 10/05Disputed with EQ - CMRRR - red'vd Nov 2nd 2007. CR - DOLA 11/01. Date opened 10/05.DV Sent - CMRRR - rec'vd Oct 30th 2007All disputes and the DV were sent with my new address. "Not mine"Here are the results:No response to DV from Asset, as of today - Dec 6th 2007.TU - Nov 27th report shows "Account info disputed by consumer". VERIFIED. Balance has also increased from $2248 up to $2257. EX - Nov 28th report. DELETED.EQ - Nov 28th report shows the TL under "Open Accounts by Credit Grantors" (Asset is most definitely not a Credit Grantor.) "Consumer disputes this account info. Collection Account."Balance has also increased from $2248 up to $2257.Disputed account Online with EQ again as "not mine" on 12/06/2007. Printed out dispute submission. Also disputed another negative TL by Diversified Adjustments, only showing on EQ, by same OC: AT&T but with a different acct number. This amount is $1789 and is listed as derog. "Subject not satisfied debt". DOFD: 04/02. Assigned 05/02. Maybe debt went from AT&T to Diversified Adjustments to A$$et Acceptance? Hopefully Div. Adj, will just be deleted after the dispute.Anyways, Asset have not responded to the timely DV, and they have continued to call me and my wife,(don't know how they got her cell #), several times a week. Each time & date is recorded. Surely they have violated a few laws here? So what do i do next? I also can't believe that EX deleted, when TU verified, and EQ just added "Consumer disputes this account info."Also, can they continue to increase the balance, even though it is clearly past SOL? MrsW
Im sure I have got them here - Collection agencies if they do not validate your debt yet continue to pursue collection activity (call or write you) Consumer protection afforded by the FDCPA Section 809 (, $1,000.Collection agencies if they have not validated your debt and they still continue to report to the credit bureaus Consumer protection afforded by the FDCPA Section 809 (, $1,000Calls any third part about your debt like relatives, etc. Consumer protection afforded by the FDCPA Section 805. (, $1,000*By the way her cell number is her business work line only* Surely something else under FDCPA Section 804 (1) (sometimes they will say who they are and why they are calling, sometimes they wont) and 805. (a3) both of us state this is a business line and it is inconvenient to call here.Collection agencies if you have sent them a cease and desist letter and they still call you Consumer protection afforded by the FDCPA Section 805 ©, $1,000These are just a few, i'm sure there are more... lovebug5
You do have them in a few FDCPA violations. Now send out another DV, request a 15-day deadline, send it CMRRR and wait for them to violate again. The more of a paper trail you have, the better your case will be should you need to move forward in court...
