klink
Hello all,I am a huge fan of all of you great credit gurus, and I just had a quick questions for anyone who can help out. If there is a thread on this already, feel free to point me in the right direction...I got an alert today that I had a new 'Public Record' on my CR. I checked it out and it is from Arrow Financial - it says the Type is simply Collections. I really don't know where it came from, nor why I owe them any money (it is around the ballpark of $900). I didn't recieve any notice of this. I was wondering if there is anything that I can do, or if anyone has any similar experiences. Is this something I can try to DV to find out what it is about?I really just want to find out what is going on, as it seems that a new public record could be pretty darn bad.Any help or advice would be GREATLY appreciated. Thank you all so very much!-Klink
Ahntara
Do you actually have a new Public Record or simply a new collection account listed?
klink
Hello Ahntara,Well my credit monitoring alert shows that I have an actual new public record, although I cannot as of yet see the record on my credit report for dispute. Maybe the alert just got here before my credit report could update, since the File date was the beginning of Dec.Keep in mind that this does not seem to be a judgement, but rather under the Type category, it says Collections.I am not sure what this money is owed for (if at all). Thanks again for any assistance!!!-Klink
Fairy Enchantress
I have a thread to from last night. I found this today I do not know if it applies to both of us or even just one of us. But here is the info!Notice of Negative InformationNotice before negative information is reported: We may report information about your account to credit bureaus. Late payments, missed payments, or other defaults on your account may be reflected in your credit report.Notice after negative information is reported: We have told a credit bureau about a late payment, missed payment or other default on your account. This information may be reflected in your credit report.Q. If the Original Creditor does not notify me of this negative information, are they in violation of the FCRA?A. Absolutely!! You may sue the original creditor in court (or negotiate to merely have the negative information removed) for $1000 per the terms of the FCRA.http://www.creditinfocenter.com/legal/NegativeInformationNotification.shtml
klink
Thank you Enchantress! The only problem is that Arrow is not the original creditor in this case. To be honest I am not really sure who is.Does anyone else have any input?-Klink

Thank you all so very much!-KlinkSince you have a credit monitoring service and you received this alert, have you pulled your reports to see where the account stands? Once we know whether or not the account has really been listed as a Judgement or a CA account, we can give you better advice.
klink
OK Guys thanks so very much!I appreciate your time and help more than you know.I pulled a copy of the CR and it doesn't appear that there are any public records on there. So I did some digging and I found that the O.C. is "A.F.S. ASSIGNEE OF HOUSEHOLD B". I looked at some dates and it looks like Arrow last reported the CO iat the beginning of the year, and not again until this month, so maybe that is where the 'Public Information' alert came from.I am really new at this credit rebuilding thing, and I am really not sure what Household B (I assume Household Bank?) thinks I owe them. Is there a way to find this out without harming SOL, etc.?You all are awesome, amazing people by the way!-Klink

First off, have you disputed this account with the CRA's as "not mine"? If you do not know what the debt is and do not believe it to be yours, the first step in your process should be disputing with the CRA's. In my opinion, at the time that you're disputing with the CRA's, you should send a letter out to Arrow basically as an untimely DV. Although they don't have to even read your letter all of the way through, you're going to start a paper trail of documents that you may need at a later date...Based upon Arrow's track record.
