I've found several with pages charges and I've also found many of the cases I'm interested in on the web, but I need them in the "official" court format.Is this something that I must go court website by court website and look for? Generally, the individual circuit appellate courts will have opinions posted on their respective websites. State District courts, generally not. A source that provides only citations is only as good as the rest of your research. It doesn't help you to cite a case that has been overturned or that numerous other courts have declined to follow. Now the next question, what is the best way to go about determining if a case has been overturned? When I find the original at the law library will it have a notation of this? I have some major cases I'm using in my lawsuit but I'm getting desperate to figure out a way to make sure I'm not blind-sided in finding out the decision was overturned. Rick9972 Posted December 27, 2007 Report Share Posted December 27, 2007 The cases found on that site are major courts. The only court that can overturn a Federal Appeals court is the Supreme Court. I do a search on cases in the Supreme court that have that name myself.Same with a State Appeals court, you search for the case on that State's Supreme court. KentWA Posted December 31, 2007 Report Share Posted December 31, 2007 Go to the law library and use Sheppards Citations. Look up the case and it will show you every case that has referenced the case you are wanting to use. That way you can find out if it was over turned, clarified in a subsequent ruling or maybe upheld many times. Also those other cited cases may help you with more ammo.
