Help w/ Arrow Financial

Hello,

Still having trouble from Arrow. I disputed first with all 3 cra's, came back verified. I dv'd them a afterwards, they sent me a letter back saying that they did not need to validate this debt since it exceeded their 30 day window from when they supposedly sent me a notice when they bought it from First Premier bank. I filed a complaint with the BBB, arrow responded with another letter saying that according to the fdcpa that they do not have to validate since it is past the 30 days, although they did tell me when I made my last payment with First premier bank and they also stated when they purchased the account but gave me no "hard" proof that the debt is indeed mine. Not sure what to do now. Thanks for the help in advance.

They don't have to validate but they cannot continue collection activity. The courts have determined that reporting to the CRA's is considered continuing collection activity.

I would write up another DV letter, again asking for the information and mention the above. Then wait about ten days and once again dispute with the CRA's. If they verify again on your reports then you have them on some FDCPA violations.

You don't mention the amounts or whether this is still within the SOL, that does have some bearing on it. Sometimes you can "wake them up" if they are still inside the SOL and they'll be off to court to sue you.

ok so the biggest neg i have is also from arrow

the accnt the are an "ASSIGNEE" of

its listed as

30 days as of past due Jan 2006

so they really bought this or are just collecting for HSBC

but anyway... im assuming this is going to play out the same as the OP..

isnt them sueing me - which they have just threatened to do (the reason i sought out some advice and found this forum) - considered a debt collection activity? ..

do i have to wait untill it comes back from the CRA's as valid before DV'ing them or can i assume that it will (since they are obviously not forgotten about this since they are saying they sue me unless i do something) and go ahead and try to take advantage of the busy holidays and send arrow a dv letter...

and i dont understand what to do about the hsbc entry for the same accnt - go ahead and DV them too? if arrow did infact buy the debt how do i get the hsbc entry off
