I was summons to appear in court in July for collections on an old credit card debt. As soon as I received the summons I sent a letter to the collections agency to verify the debt. When I went to court the attorney did not know I had requested validation and once he read the file he said that i should go home and they would contact me by mail. I did and I have still not received any information form them. The other day I received a letter from the court requesting that I respond to discovery. I'm really confused. I don't have validation of the debt yet so do I have any other options? The collection agency claims they were trying to contact me for months but they were doing so under my maiden name so the mail was thrown out as junk mail - never opened and we don't answer calls on the phone that don't show a phone number in caller ID so I never spoke to anyone about it until I was served. montanatim Posted December 14, 2007 Report Share Posted December 14, 2007 It looks like you are being sued. At a minimum contact the court and see just what the status of the case is. If you did not file an answer to the complaint, with the court, I'm not sure why there is a discovery request. My best suggestion at this late date in the game is to speak to an attorney. go to: www.naca.com and find a specialist in your area if you want to try to salvage the situation. Amerikaner83 Posted December 14, 2007 Report Share Posted December 14, 2007 I agree...at this point, DVing is esentially useless.....you do have Discovery on your side however I believe.....it works for you as well as for the Plaintiff...But I think your best bet at this point is to see where the process is (go to the courthouse) and find an attorney from www.naca.net Link to comment Share on other sites More sharing options...
