katrina1231 Posted December 14, 2007 Report Share Posted December 14, 2007 i dv'd a collection agency on 10/29...today (12/14) i received copies of old bills from the original creditor dated 2000...what o i do know? i know it's past the 30 days from the dv and it's also out of SOL in NJ....what's my next step? Forget it.If you're 100% sure the SOL has expired, then you write, embellished as you see fit:"The Statute of Limitations on this alleged debt has expired. Do not contact me again."One thing you could add:"If you file a lawsuit, I will raise this as an affirmative defense, and file a counter-claim against you for filing when you knew the SOL had expired, seeking damages, attorney's fees and court costs."DH Link to comment Share on other sites More sharing options...
