(a) Reinvestigations of Disputed Information

(1) Reinvestigation Required

(B) Requirements Relating to Reinsertion of Previously Deleted Material

(ii) Notice to consumer. If any information that has been deleted from a consumer's file pursuant to subparagraph (A) is reinserted in the file, the consumer reporting agency shall notify the consumer of the reinsertion in writing not later than 5 business days after the reinsertion or, if authorized by the consumer for that purpose, by any other means available to the agency.

(iii) Additional information. As part of, or in addition to, the notice under clause (ii), a consumer reporting agency shall provide to a consumer in writing not later than 5 business days after the date of the reinsertion

Hi guys!

I sent TU a letter telling them about the reinsertion of a deleted account in Dec 07 and two more letters reguarding the same issue in Jan 08. One responce was - they do not have the account on my credit report. Then after I sent more letters proving again it was on my report the gave me a letter saying - my dispute was frivolous.

So today I called TU explained everything to a rep Ashley Walters. She transfers me to a supervisor Susan. Susan gets on the phone and hangs up somehow.:roll: So I call back get Don Jefferson. I explain everything to him again. He transfers me to Susan. She actually said they do not have to follow the rules of the FCRA or FTC. (All the reps sounded like they were from India) So I don't think she knows what she was talking about. I asked for her supervisors name and to be transfered to him/her. She said I can not give you my supervisors name. And they are not there any how so call back tomorrow.:o

Where do I go from here? Ask for Special Handling?

They do have a legal right to deem a dispute frivolous. Did you happend to dispute several times within a 30-60 day period? It's usually best to wait at least 30-60 days before redisputing.

However, all that aside, I would have loved to have her send me what she said in writing. :evil: Frivolous or not, I bet they would love not to have to follow the FCRA! I would be sending that complaint off to FTC, My States Attorney General and theirs, and anyone else I could possibly send it to.

I once disputed with the credit reporting agency to add a statement on a judgment, well instead of adding the statement the credit reporting agency deleted the judgment. Then a year later they reinserted. I simply wrote back saying that 5 business day notice of reinsertion had not been given and I wanted said item to be removed. They deleted, and it was never reinserted after that.

If you have trouble disputing then recommend that you file a dispute through the FTC dispute referral program. Usually that gets them to take you seriously.

Reference of the reinsertion rules is also listed on a copy of your summary of rights. Usually comes with your credit report.

Was this ever resolved?

I had a collecion acct that was removed about 2 months ago and it magically appeared again.

Hi NYLady,

On 3-6-08 I checked TU and the collection is off my report again! Should I be happy? I am not really sure because with Trans Union it could be right back on. :neutral:
