Can Unifund do this? I doubt it's legal.

They sent me a settlement agreement letter to be fufilled by the end of this month ( Dec 31).

I received a letter from them today with a diffrent total and they are asking for full payment by the end of the month.

I have DV'd them and all they sent me was a copy of the original statment from AT&T Visa with the last balance charged off which was 3,600.00.

The DV letter has no calculation what so ever of the figure they now have of 6,150.00. The interest rate UNIFUND tacked on is outrages IMO.

Before this last letter requesting full payment of 6,100 the settlement agreement was 4,200.00.

So are they allowed to turn around and demand full payment after the settlement letter they sent me and I agreed upon over the phone?

Can I just send the settlement offer amount and if they try and collect the rest just go from there?

I would send them a copy of the settlement agree along with another letter saying something to the effect of "Cashing of this check/money order (check#/money order#) constitutes PAYMENT IN FULL for account number XXXXXXXXX per the attached settlement agreement and will be reflected on all credit reporting agencies to which Unifund reports." Be sure to keep copies of all this and send that letter CMRRR so you have proof they received it.
