I would really hate to sue you!!!!

Greetings Folks, can you guys do a little critique of this follow-up DV letter to AlliedInterstate(Who never responded to this timely dv letter). This $ 58 paid Verizon account is a pain in my blank!!!

12/20/07

Allied Interstate

Address 3000 Corporate Exchange Dr.

Columbus OH 43231

RE; Creditor Account # 215508136XXX

Allied Interstate Account# 11742XXX

This is my second correspondence to your organization regarding the above mentioned alleged debt. My first letter was sent to you on 11/18/07 via certified mail, and signed for by <insert name> at< insert time>. The correspondence was a “Timely” debt validation letter sent to you in response to your letter sent to me on <insert date>. Under the doctrine of estoppel by silence, Engelhardt v Gravens (Mo) 281 SW 715, 719, I may presume that no proof of the alleged debt, nor therefore any such debt, in fact exists.

Immediately remove this collection listing from my credit reports or I will be forced to pursue this within a legal forum. Non-Compliance of this request entails that you are in violation of the FDCPA, section 809 (. Please contact Equifax and Experian regarding the deletion of this information from my credit files immediately. Please do so within 10 business days of the receipt of this correspondence.

it's paid.

That being said - they never had to respond to your DV - it is PAID.

They don't have to respond to that either....wanna know why? It's PAID.

You need to go a different route. See if they're reporting anything "innaccurately". How long ago did you pay it? Did you dispute with the CRas as "paid before collections" or "not mine"?

It is presenting as two TLs states was collection paid/ the other just states collection. But, they sent the initial communication, and also I believe this is the second JDB that bought it.

I forgot to ask you this earlier (side bar), I have been going other routes ie-disputing specific items within the TL, and Experian will not budge, they will not even reinvestigate>>>> :?

OK let's think this thru - start by answering the questions I posted earlier.

Then answer these:

Are they trying to collect from you on a bill you already paid? Did you pay in full or part? If in part, are they trying to collect the remainder?

The "other route" I mentioned depends on your answers.

Ok,

Their are two trade lines- one where I paid in full (it was only 58 bucks)

The second TL is the CO line item. It has been paid in full but showing twice. I recieved a dunning letter from Allied, they are not showing up on any inq- The line items are showing as if Verizon the Original Creditor still own the debt.

Did I make sense. My thoughts can be disjointed sometimes. And by the way sometimes a little ADHD. I am a drug rep and sell a med for ADHD, I should take it myself (SMile)!!! :p

So here is how I read your story.

You paid off Verizon, the OC, possibly after they had charged it off or they had already sent the debt to a CA. Now the CA is going after the debt and reported it to the CRA.

If that is correct then it should be an easy fix as long as you have a statement showing the OC account has been paid in full.

First you need to dispute it with the CRAs and it may come off in 30 days. Then I would simply send a dispute letter to the CA with enclosures of the paid in full letter from the OC. No one should call a CA, but I have had success in calling them if I have the proof that I have paid the debt from the OC. I ask, "what do you need from me to prove I paid this off?"

Creditors and Collection companies do not keep in contact with each other once they buy and sell a debt. They arent as good of friends as they should be. Blah Blah Blah.

Very good points you made. That is probably what happened in regards to the two tls simultaneously presenting. I paid verizon, but it was already in route to CA.
