lrogers621
Someone please clarify for me the significance of an Orginal Creditor selling a debt to a collection agency or JDB and what this means for the CA right's to collect the debt. A lawyer firm out of Austin is handling for Liberty Point Corp. What is the defense if it has been sold vs assigned? Thanks
willingtocope
CAs don't buy debts. JDBs buy debts. Some JDBs have CAs working for them to do the debtor hassling. In legal terms, "sold" and "assigned" may mean the same thing. In CA terms, they may be "assigned" (i.e., contracted) to collect the debt.Anyway, the general defense against a JDB is to pursue the "chain of custody". Do a search on the board here about that and you'll find some additional info.
