Poor Credit Posted December 27, 2007 Report Share Posted December 27, 2007 I was able to shake of a JDB lawsuit in court as they folded for me once I sent them discovery. I was not sharp enough then to ask for a removal in writing along with the mutual agreement to dismiss with prejudice and now I cannot get them to delete the trade line. I have e-mailed the attorney and asked them to remove it as this is what we agreed to and you couldnt validate it in court so how is your client validating it now? No reply and no response from the JDB after sending them a letter either. How do you get them to remove a dismiss case when you was not knowledgable enough "then" to get it in writting? brokeinok Posted December 27, 2007 Report Share Posted December 27, 2007 You need to approach this from the FCRA standpoint rather than FDCPA. You have the right to request an "investigation" from the data furnisher following a verified dispute through the CRA and they are required by law to respond within 30 days or delete the TL, no response, $1,000 penalty. (I DVed LVNV & Asshat Acceptance for separate accounts in November, and disputed with the CRAs at the same time.
