I submitted enough information for you to carry out a reasonable investigation of my dispute, since you obviously did not investigate this account thoroughly enough the last time I submitted one.If you had investigated properly, rather than use your e-Oscar system, you would have known, that not only I have never been late on this account, but that I am not sure that the account is even mine – though your company claims to have “verified” this. It is at this time that I will point out that in Cushman v TransUnion, Stevenson v. TRW (Experian), and Richardson v. Fleet, Equifax, et al, the courts ruled each and every time that the CRA couldn't merely "parrot" information from the creditors and collection agencies...that they have to conduct an independent REASONABLE investigation to ensure the validity of the debt and the honesty/integrity of the creditor/CA in question. Sending out a generic form through the e-Oscar system that does not even contain my reasons for the dispute is not reasonable.If you do not initiate an investigation regarding my dispute, as is my right under the Fair Credit Reporting Act, I will have to take legal action to protect my credit rating and myself. I have my letters to the CA's ready to go. I also need to send DV letters to the CRA's. My question is how do you word the Valadition request to the CRA's? Ahntara Posted December 30, 2007 Report Share Posted December 30, 2007 You may wish to read up a bit more before you send correspondence.DV = Debt Validation, is for CA's.You dispute or request an investigation (under the FCRA) from the CRA's. brokeinok Posted December 30, 2007 Report Share Posted December 30, 2007 You might want to look under the credit repair link above and find the flow chart, that will help you with the time line and the order to do things in.Also, CRA's = Credit Reporting Agency and for these, you will need to write a dispute letter to each one based on any incorrect information on the credit reports you've receivedCA = Collection Agency, these are the ones you send your DV (debt validation letters to). You need to know for sure if your debts are within the SOL for your state BEFORE doing this. If the amount of the debt is significant, sending a DV before the SOL has expired can sometimes result in renewed collection activity and them suing you for the account.Investigation = this is something you can request from a CRA and also the CA if your initial disputes come back as verified. Hope this helps, I do think you need to read a bit more before you start mailing correspondence since it seems you have some things reversed.
