Summons and Complaint Confused

I will try to call the court house on Monday.

This is actually a great first move. See if this is legit. It's not in front of me, but from what you've written - it sounds hokey to me that an attorney from California would be filing against you in OR. Is this person on the OR State Bar?

EDIT: The attorney information listed on this document, does it appear the paperwork is coming from the California attorney or from a local attorney with only a note attached from the California attorney? Sorry, saw your other post and wanted to confirm that.

If this does turn out to be bogus, in your shoes I would count the violations and send an ITS. This kind of thing would really tick me off...

Another thing, aren't court papers supposed to be stamped by the courthouse? Does this summons lack that?

The only stamp is a stamp that states Certified to be a true and correct copy of the original and of the whole therof attorneys for the plaintiff with the attorney's signature.

This sounds like it's been noterized. I think for it to be official there needs to be a stamp from the court as well. Anyone?

I did check, this attorney is licensed in Oregon after all, but the paper only has the law office info from California listed on the lower left along with a California phone number- no attachments.

Then it wouldn't matter where the Attorney's address is as long as the attorney is licensed to practice in your state.

It still doesn't sound right not having a stamp from the courts. Best bet would still be to check the courthouse for the filing. If it's not there, you have some hefty proof of a violation.

Also make a note to not only check with the courthouse on Monday, but through the week as well. It could be a California office is handling it, but they are having a lackey file it this week. You never know and if that is the case, you could start organizing an Answer.

Anyone else have input?

You will soon receive a second set of docs that have been stamped by the courthouse once they have actually been properly filed. The set you received is a copy of what was going to be filed; a plaintiff can call in advance to get a case number assigned, which is why it's handwritten.
