froggman2k Posted December 31, 2007 Report Share Posted December 31, 2007 Good morning all-It's been several months that I've been lurking here on the boards, and I finally have a question that I can't seem to get the answer for.In my original DV to the CA handling this medical collection, I asked for the address and phone number of the original creditor. All they sent back was a fax of a computer print-out they received from the OC. No identifiable contact information was listed anywhere, and I can't even find this OC through the regular means (yellow pages, etc).Any idea how I can get their info to talk to them directly? I'm more than willing to pay this, as it was actually an oversight from a snowboarding accident several years ago. I didn't have insurance at the time and so was making so many payments to so many medical facilities, that this one got missed :-/. I'd like to work with the OC directly so that they get their payment and I can get this off my credit, but I can't do that if I can't contact them!Any help in this area is greatly appreciated! willingtocope Posted December 31, 2007 Report Share Posted December 31, 2007 Welcome...and stay off those snow boards...Sounds like you've already DV'd these people...but I'd suggest you do it again. Include a copy of what they sent you and point out that according to the FDCPA (See above) they are supposed to provide you with the name and address of the OC...and, according to FTC opinions, the DV should come from the OC directly and not just regurgitate what's in the CAs records. I have found the original creditor's information from a previous correspondence with the CA, so I am attempting now to circumvent the CA and go directly to the OC. I have written up this letter, and was wondering if any of the gurus here have any tweaks they'd like to suggest:----------To Whom It May Concern: I have recently received information about a debt that I owe to your office from March 2003, placed with (CA) in Boulder, Colorado.First of all, please allow me to humbly apologize that this debt has gone unpaid for so long. This was a difficult time in my life, and while I made every attempt to pay all of my debts, this one appears to have been overlooked. Please accept my apology.Further, I would really like the opportunity to settle the debt with you immediately and directly. If you would recall this debt from the Collection Agency to which it is currently assigned, I am more than happy to provide full payment immediately, in the amount of $496, in whatever form is most desired by your office, whether it be by check or payment via credit card over the phone. The recall of this debt should include all records held by the Collection Agency being purged, such that no further collection practices are possible by the agency.Finally, can I please get a copy of records of any treatment that I received in connection with the amount due? All I have been given, due to HIPAA disclosure agreements I would assume, is a record of the debt being assigned to the Collection Agency.Please let me know how we can settle this in a timely and amicable manner by responding via US Mail to this letter.
