Please let me know. Need to start getting out of this debt. Lawyer suggested against ch. 13 and to look into another route, so i am going to try it out. I almost went the bankruptcy route... but decided against it. Would like some help, thats why I ask. I just get so stressed over this, I need help. I havent used a credit card in months. I use cash for everything, or my debit card... using cards just turns to an endless cycle of maxing out one and then paying the nmin and maxing it out again. willingtocope Posted January 2, 2008 Report Share Posted January 2, 2008 If what you're looking to do is "settle" your debts for less than what the creditors want, then BK 13 is the only way to go. You get your lawyer and the BK court to do the negotiating for you, and the BK court makes the creditors play nice. Your credit gets trashed, but that's going to happen anyway.If you intend to pay your creditors back in full (minus their exhorbitant interest and fees), then sit down and work out a budget. Figure how much you need for food, clothing, place to live, transportation. Whatever is left, divide up among your creditors. Call them. Ask for the hardship department. Tell them what you can afford to pay. Don't negotiate. Don't agree to anything before you've talked to all of them. If one or more won't play along, see above.
