So 6 more months this is over the SOL. As I said in other threads, I am on disability and have no income to pay this debt. I am going to send DV. There after, what can I tell them so I can delay and keep them from suing me before SOL is up? What are some of the best delay tactics?BTW, When exactly is the end of 30 days limit for DV? trueq Posted January 7, 2008 Report Share Posted January 7, 2008 At this point, a DV will draw attention to the account.The time to DV was back when it first went to collection.DV letters can sometimes speed legal action with bottom feeders because you are making their life difficult on collecting the debt.My best advice is to do nothing. They may do nothing and let the SOL run out.Most suits are predicated on the fact that they think you have assets to recover by a public records search. If you have no assets to speak of, doing nothing is a good plan.If you have assets to protect YOU MAY WANT TO CONSIDER A DV, because lets face it, you will need to fight and a DV is a decent start.You may want to wait for some more advice from others as well on this one! jetscarbie Posted January 8, 2008 Report Share Posted January 8, 2008 I look at a DV as a paper to protect yourself in case sh*t happens.Say you DV them after recieving their dunning letter. They don't respond. Say in 4 months from that time they decide to sue you. You have a paper that shows you tried to fix the situation but they fell short.Personally, IMO, I don't think DV's do to much except what I said above. Some creditors still call after I DV them.....but that's good b/c it gives me proof that they are scum. I want the proof....just in case they decide to sue. I like having a hold over them.
