bigdebt Posted January 7, 2008 Report Share Posted January 7, 2008 hi everybody i just got off the phone with trans union,i called them to get the DOFD on a old sears account and its nov 2001. so i ask for DOFD for the same account that LVNV brought and there date is jan 2002. same with CAP1, DOFD nov 2001 LVNV brought that and reports dec 2001. so how do i go about getting LVNV to report these right? there attemping to reage these 2 accounts right? bigdebt Posted January 10, 2008 Author Report Share Posted January 10, 2008 thank your for the reply rmuse00 well they called again to day and i said on jan 7 when your office called i requested DV.she said i see a note of that here but it has to be sent here in writing.i also told her that they shouldnt be calling me about this untill i get my DV.her reply was if you want ill take your phone number out of our system i said ok i ll send you a letter tomorrow, she gave me the address to send it to.but its a po box you think she trying to delay my 30 days? rmuse00 Posted January 10, 2008 Report Share Posted January 10, 2008 Yes I agree with NascarDevil. I would not wait too long and send a DV whether or not you recieve their communication. If you search lvnv you will see that they like to violate. What if they say they sent it and for some reason you did not receive it. They just have to prove that they had a system in place to send out their communication regarding this debt they don't have to prove that you actually did receive it. You can mention that per their phone call you are requesting validation for the debt in question. You can definitely still send to a P.O. Box and remember with these people send it certified. With CA's like these once they know you are aware of your consumer rights in regards to requesting debt validation they will hopefully follow the FDCPA guidelines developed to keep them in check. bigdebt Posted January 10, 2008 Author Report Share Posted January 10, 2008 Thanks all. ok today i wrote a very simple dv letterit goes as follows, This letter is being sent to tou in response to a phone call made to me Jan 7 2008 from your office about this alledged debt.This not a refusal to pay but a notice sent that your claim is disputed and validation is requested.i would also like to request that no phone calls be made to my home.All future communication with me will be done in writting and sent to the address noted in this letter by USPS Regards Ill send this tommorrow. I checked my other credit reports and this is suppose to fall off around Oct-Nov 2008. I live in MASS the sol for this is 6 years so im pass the 6 years by about 2 months. Try something along the lines of "...my schedules varies, so it's best to contact me by mail only..." - just a suggestion. Or you could mention that phone calls are inconvenient, please communicate in writing only.IMO, you should never tip your hand about expired SOL. If they decide to sue you, it's a slam dunk defense.
