rocky12 Posted January 9, 2008 Report Share Posted January 9, 2008 What does this mean? My daughter found it. We are in the process of getting things together to file BK. I have contacted my attny and am waiting to hear back but in the meantime I am panicking. Do I call the phone # for the sheriff or wait? I am guessing it means someone (probably Am Ex - the most past due) is suing us. Do we have to go get papers form the sheriff? I do not want the sheriff car coming back! He must have come while I was picking my kids up form school. I am mortified already b/c I am sure some of my neighbors saw and will ask what's up. WHat should I do now?never mind - i freaked too quick. just talked to attny. and then the sheriff and it is in regards to our company - that is no longer operationg but owes monay. It's an LLC. Does anyone know what will happen with it in our BK? Will we need to file a seperate corporate BK or will it go away with the personal one? Make something up if you want to...like he was dropping off a complaint form for you to fill out for identity fraud or something.As for being sued. Yup, that's probably why. Until your BK case is FILED, you have no protections. Get It Filed. The second it is in the BANKO system (electronic bankruptcy records) all actions stop, even if they have sued you. Your attorney just sends a letter to the other party saying you are in bankruptcy and they either voluntarily dismiss the case, or your attorney shows up on the return date and tells the judge they are in violation of bankruptcy code for attempting to continue the action.Done, door slammed...thank you for playing Mr. Creditor. LadynRed Posted January 9, 2008 Report Share Posted January 9, 2008 As for your company, if you personally guaranteed the payments on the company credit accounts, then your bankruptcy will remove YOUR liability for all of it.
