Trying to settle... what now?

Okay... I'm trying to settle this CC debt through an attorney who is representing the OC.

I've offered a lump sum payment of 40% of the total, got a letter back from the attorney, pay the lump sum of 75% of the total within 10 days.

So I sent a second offer, fine 75% it is but only if I can pay 15% of that down and split the remainder into four payments. Get another letter back from the attorney exactly the same as the first one. Didn't even respond to the payment issue.

So I send a third offer, basically reinterating my plan to pay and asking for a response to that. I get another letter back from the attorney.... guess they have copies of it run off and just change the dates.. didn't respond again, say exact verbage as the first two letters.

So now what? Should I go around him and talk to the OC, tell them he isn't even trying to settle their claim? Can I even do that since they have already filed a court action? Write the attorney again and send a copy to the president of the OC cc company?

I have no real legal standing on this one, it's mine, they haven't violated anything and I do want to pay it before I end up with a judgment, but I don't have that 75% in case payable in ten days.

I would venture to think the OC, when confronted with your genuine offer to settle with lawyer, not one, not 2, but 3 times, you getting the same damn form letter back...they might be able to do somethin for ya directly.

Just becuase it's in the Court action right now doesn't mean you can't negotiate directly...just that you need to remember the court timelines are still in effect, no matter what the settlement road brings.
