Filing an answer will preserve your legal rights and prevent them from getting a default judgment. wentbroke is incorrect, they are not bluffing. Cap One files (an follows through with) suits for relatively small amounts...they filed against me for roughly the same amount as yours. Captital One is scum.Not bluffing:( sued me for $1567.00 They do keep good records and are hard to beat in court. Then, find out what you ACTUALLY owe them in the discovery phase. They WILL offer a settlement more to your liking after/at that point.Just dont let them get a default judgement.....answer!
