I don't know for certain, but I am sure they have been attempting to collect this debt for over 30 days now. First question, if it's beyond the 30 day time limit can I still DV them? They are reporting on all 3 CR. Do I include this para still? At this time I will also inform you that if your offices have reported invalidated information to any of the 3 major Credit Bureau’s (Equifax, Experian or TransUnion) this action might constitute fraud under both Federal and State Laws. Due to this fact, if any negative mark is found on any of my credit reports by your company or the company that you represent I will not hesitate in bringing legal action against you for the following: and this one?Also during this validation period, if any action is taken which could be considered detrimental to any of my credit reports, I will consult with my legal counsel for suit. This includes any listing any information to a credit reporting repository that could be inaccurate or invalidated or verifying an account as accurate when in fact there is no provided proof that it is. lovebug5 Posted January 10, 2008 Report Share Posted January 10, 2008 Also, please keep in mind that you should somewhat stray away from copying form letters that you find on the internet. Robert Nashville/Savannah Posted January 10, 2008 Report Share Posted January 10, 2008 Just my $0.02 but...I never use the paragraphs you are asking about - the best dispute letter you can send is one you draft yourself specific to the situation you are addressing.Use the "form letters" for ideas but make the words your oww and I'd use as little "legal sounding jargon" as possible. Takin' Charge Posted January 11, 2008 Author Report Share Posted January 11, 2008 Thanks for your replies. As for using the form letters, your advice is well received. I remember reading that on a page somewhere in CICland. This will be my first DV so what I planned to do was copy the form letter into a document, print it out and use it as a guide while I re-word everything. My question at this point is whether or not I should include information in those paragraphs. The reason I ask is that the CA is already reporting this information on my CR. It seems as though it would sound stupid if I asked (told) them not to START reporting anything if they have already begun to do so. Maybe I should ask them to stop reporting or remove the TL. However, it seems if I request removal until validated and the debt is validated, then it'll go back on my CR and be more recent than it is now. I'm not sure if I just talked myself into a circle or not. Hopefully someone out there will understand what I'm saying and offer help.
