Takin' Charge
I received a phone call today from Midland Credit MGMT (MCM). I don't know for certain, but I am sure they have been attempting to collect this debt for over 30 days now. First question, if it's beyond the 30 day time limit can I still DV them? They are reporting on all 3 CR. Do I include this para still? At this time I will also inform you that if your offices have reported invalidated information to any of the 3 major Credit Bureau’s (Equifax, Experian or TransUnion) this action might constitute fraud under both Federal and State Laws. Due to this fact, if any negative mark is found on any of my credit reports by your company or the company that you represent I will not hesitate in bringing legal action against you for the following: and this one? Also during this validation period, if any action is taken which could be considered detrimental to any of my credit reports, I will consult with my legal counsel for suit. This includes any listing any information to a credit reporting repository that could be inaccurate or invalidated or verifying an account as accurate when in fact there is no provided proof that it is. rmuse00
Why not. It is my understanding that whether or not the debt is within the 30 day window it is still our right as consumers to dispute any inaccurate information and to seek legal counsel if after several attempts to correct their records they continue to report inaccurate information. I initially found accounts that were never mine and I never got a notice in the mail. I disputed and they continued to list on my report so I had the right to seek legal counsel since they were not validating but were verifying with the CRA's. Fortunately for them they realized they did have the wrong person. However, this did not happen until after they ignored 2 DV's and verified with the CRA's twice.
