Time to Sue midland?

I have an old paid collection from MCM. I did the whole procedure for dispute, DV, etc. The recently updated from a paid collection (from an old credit card) to an open installment account 120 days late with a 0 balance. This dropped my score 100 points. WTF? The original account iwas revolving and I never made any payment to mcm that would make it 120 days late. It was paid off years ago before I found this site. Every month I dispute and they verify. They consitantly ignore my DV attempts. I am ready to sue them but have never done anything like that. How can I figure out what are the exact laws they are breaking? I am in Texas so they are also breaking the TFC by ignoring me. What do I do next?

You might want to check with NACA (National Association of Consumer Attorneys). I am sure you can find one in Texas.

One of the features of the FDCPA and FCRA is that there is a provision for award of attorney fees if you prevail in the suit. A NACA attorney would be able to look at your case and tell you how much of a slam dunk it really is. If it is well documented and straightforward, the NACA attorney might be willing to take the case on a deferred fee basis. In other words, he knows he will get paid and knows the case is easy so there would not be a retainer fee.

This approach may or may not work. Give this a shot before you charge off in another direction.
