LeslieR
I am getting ready to FOAD, but want to make sure of a few things before I do. I really have searched, and I have some info to answer these questions but need some clarification.Do telephone accounts fall under the UCC in both OH and CA? (and therefore are subject to the four year SOL)?If not, can someone let me know what these accounts are considered for SOL purposes in both OH and CA?If the account was held in OH but I am now a resident of CA, which SOL would currently apply *if in fact they are different*?I am getting ready to send a FOAD letter out, but I really want double check my understanding about this SOL before I do.Thanks! willingtocope
I can't answer all your questions, but I can tell you that its the CA SOL that will govern you being sued in CA. They might sue in OH, but then they'd have to "domesticate" the judgement to CA before they could take any money from you. And, the real problem with utility bills (including cell phones) is that those people have very long memory and also very long arms. Regardless of whether they win in court, the may be able to refuse you service at some point down the line.
