I received a letter today from Citi today asking for information due to a recent dispute with the CRAs. It reads:

Dear CloudX,

If you are questioning the information that we reported to the consumer reporting agencies, please send us your 16 digit credit card number, a copy of the credit report dated within the past 30 days showing the items in question, and a letter of explation to:

Citibank

PO Box 6241

Sioux Falls, SD 57117-6241

Once this information is received, we will investigate and submit any necessary updates to the consumer reporting agencies.

Manager

Anyway, the point of this is, I have DVed academy collections who is collecting on their behalf twice in the last 2 almost 3 months (they never responded.) I have also, about 2 weeks ago, sent a letter to the CRAs about academy not responding and this is the first letter I get.

Is this a stall tactic? Should I ignore it? Or should I respond with all info plus copies of my DVs I sent to academy?

Citi is trying to investigate the account. They can ask for that kind of information. Read the link at the top of this page about disputing with OC. While you never actually disputed with the OC I think the CA might have started it when they requested information from Citi..

Is the account yours? do you have the information they are requesting?

Try this...

Call the CA and tell the CA's supervisor

that you are filing BK..you

just haven't found a lawyer but definetly are filing..

get the sups name just to show him you are serious.

then

tell the sup. that you will be calling

Citi when you hang up with him.

I've know that if you tell Citi's assigned CA's that you are

filing BK they are immediately to send it back to Citi.

I'm assuming you want to deal with Citi and not the CA right?

Then in 1 day call Citi and raise hell about the CA

(Citi hates dealing with CA complaints.)

and that you told him that you were filing BK and you

want to know were your file is.

then make a payment arrangement- :-)

When I was on the mainland (that's what we call the continental USA here on Hawaii)

I worked for CitiBanks Recovery Dept.

If this is a fairly recent collection ( the account is still with an assigned collector) the SOP ( standard operating procedure) for assigned

collectors are to send the account back to Citi

when when the debtor informs the CA

that s/he is filing BK or is with a CCCS.

The CA will send it back

especially when you tell the CA

( after informing them of the new info-bkr CCCS)

that you will immediately be contacting Citi's Recovery Dept.

that's why you want to talk to a manager.

To Whom It May Concern:

This letter is being sent to you in response to your letter dated January 08, 2008. I appreciate the timeliness of your response to my disputes with consumer reporting agencies. The information that I am disputing with the agencies is a current collection that is on my credit report. I have also, since November 7, 2007, been disputing this record with Academy Collections who has been trying to collect on your behalf. As of the date of this letter, I have not received validation of the debt owed.

Since you have obviously verified this debt, then I respectfully request that your offices conduct an investigation on this account. I have reprinted the legal text of the FCRA for your legal staff, to show that under law I have a right to ask for this.

I would like to see from your offices, so that this matter can be cleared up, all evidence that points to a validation of this debt. I appreciate your prompt attention to this matter, and I hope you appreciate mine.

However you will be in violation of the FCRA if you do not comply and respond to me with the results of the investigation in 30 days. If I don’t hear from you within that period, I will assume you do not have the information at hand, will take legal action as is my right.

If you can not provide any evidence to the matter, please update my report. Again I thank you for your attention to this matter and I look forward to hearing from you shortly.

I have enclosed your original letter (copy,) copy of State ID, the letters (2) sent to Academy Collections, and a copy of each letter sent to the consumer reporting agencies.
