mimosa
A daycare put me in collections which was put on my credit report for ONLY late fees and fees on top of the late fees which I was never late on. I have PROOF that shows that what is charged is only late fees that were put on my account before my bill was actually due.I have disputed this info on my credit report but it comes back as 'remains'I have contacted the collector and told them I had proof and they said 'we will not accept your proof because we work for the daycare'Before it went to collections I tried to speak with the manager of the daycare about this proof and she refused to look at it because she KNEW she didnt do anything wrong. Do I have a reason here to sue?Do I sue the original credit? If so for what?
Fozzle
Send a letter to the Better Business Bureau and courtesy copy the daycare center and whatever agency oversees the DCs in your locale. Let the BBB know that if this is not removed from your credit reports, you will file suit against the DC. Yes, you can sue if they are putting inaccurate information on your credit report.Incidentally, a lot of people may post that the BBB is a toothless and worthless organization, which may or may not be true, but I've contacted them 7 or 8 times across the country and only once did they not do anything -- and that was an instance I didn't follow up on. Basically since you have documented proof, that will show the DC that you are not messing around.
mimosa
Thank you.......the BBB never popped in my head. I figured I could sue them but I was unclear if reporting wrong information was the only reason. I think I am going to try to find some more information tomorrow from legal aid (dont know if they can help though)
