universityprof
Had a corporate card, closed account in 12/2004, sent letter CMMR telling them to close account and paid balance off in 12/04. Was sent notice account closed 12/28/04 and 1/05 statement showing $0 balance with account closed and paid. Checked credit in 12/05 and account was not on credit.Checked credit 11/07 account appears as charge off closed 5/05 with $367 balance. Disputed with CRA's and called and wrote AMEX. Amex said the did not have any records fro account, transfered to collection dept. They said would research, never heard anything further. All cra's returned as verified 12/20/07. Then on 1/4/08 received letters from all three CRA's. Equifax deleted account due to fraud and placed fraud alert on account. TU changed to paid charge off as of 11/05 and EX changed to paid charge off as of 5/05.Mailed detailed letter to AMEX 1/5/08 with all letters and proof of account closure. Received reply yesterday stating account has no records but they will not remove from CRA's and stated it was CRA's fault and to deal with them. Attorney friend said sue, great case numerous violations.
jetscarbie
Attorney friend said sue, great case numerous violations.I'm not an attorney but......seems like it would be the CA's fault and the CRA's fault.Someone vertified the accounts with 2 of the CRA's. If amex didn't (and they say they didn't if they told you to go after the CRA) then I would bet you have to go after the CRA.Who was the CA? universityprof
No, CA. Only American Express. They also admitted the never attempted to contact me, no letters, no phone calls. If they had closed the account as they stated in 12/04. This would be a moot point. They are the ones reporting to the CRA's from the following address:AMERICAN EXPRESS P.O. BOX 7871, FORT LAUDERDALE, FL 33329
msldystrkr
Seems like you should be researching both TU and EX along with AE to take to court. IT is not any more involved to sue one as it would be to sue them all so they can fight about who is responsible among themselves. And remember that it is not your responsibility to determine who is at fault among these 3. Bottom line is that you disputed with all 3, re-disputed again and it is still not reporting correctly. So your damages would be from all 3...
