ScrewedinWV Posted January 19, 2008 Report Share Posted January 19, 2008 Ok, I worked with WAMU to get a settlement. I got one nearly a year ago. I had one CA write me after that. I asked for a DV. They sent me one w/ the payment on it, but tried to collect the rest. I sent them a copy of the settlement letter. They quit trying to collect. Now, in Dec. I got another CA(?) letter for this same acct. They called me. I asked them to write me/they said NO. I asked them to DV/they said no that I'd supposedly gotten lots of letters and did not, but I have no proof I did not get it. Well, not really wishing to talk on the phone with them since I know that's a cardinal sin really, I said I'd send them a copy of my settlement letter. They said there was not one. The lady was really ugly. Well, I lost my composure, and let it slip that I knew they were probably a JDB anyhow and they just needed to understand that I DID have said letter. They began to get nervous that I'd mentioned JDB's and asked where I'd heard such rubbish. I told them I did my research. The lady told me that she'd recorded my conversation and I said I hope you did since you're trying to collect a settled account. She said she was going to put a bad remark on my CR. I told her I get a copy every quarter and it was settled. She hung up after saying I DID owe the money and they WOULD be collecting it. They have since sent me a settlement offer letter of their own. I plan to only respond with a copy of the settlement letter. Is this the next step? Since it didn't work last time, I'm now not sure it's correct.Thanks in advance. WV is a one party state, meaning you can record the other party without their consent. If the CA is in a two party state they would have broken the law by not telling you in advance they were recording the call. Then WAMU apparently screws up and sells the remainder to a JDB?This JDB calls to collect and records the call.... it seems to me that WAMU screwed up, maybe owes you $ for doing so and the fact that the call is recorded is going to work in your favor.You need to send the settlement letter from WAMU to this JDB and stay off the phone with them. brokeinok Posted January 19, 2008 Report Share Posted January 19, 2008 Does the settlement letter specifically state that they cannot sell, assign, transfer or attempt to collect the remaining balance?
