It has been charged off 7 times from oc. dolp was 5/2005, and now lvnv has it!! yea from what i have read about them!!! I was truthful on the application but somehow still got the car. the co amount is 1290 but the current amount according to lvnv is 2318. What should i do?? It has been placed with an attorneys office. enclosed is copy of sherman acquistion's privacy notice.account is seriuosly past due and must be PIF or we will proceed with appropriate activity. then blah blah blah.That is just a short version of what was sent. brokeinok Posted January 19, 2008 Report Share Posted January 19, 2008 Okay, first off, go to the link at the top of the page and read everything about the debt validation (DV) process. Come back here when you are done with any questions or things that need clarifying. Also look up the SOL for your state.Second, LVNV is a rats nest and they like to move things around to their various sub-sidiary companies to avoid answering a DV (cause they very seldom can prove anything. So, go to www. budhibbs.com and look up LVNV funding. Get the addresses for every one of their companies listed.Third, type up a DV request letter. There are samples on the site but do not use it exactly as written, personalize for yourself so it doesn't sound like a form letter. I usually delete most of the stuff out and keep it short and sweet.Fourth, mail all the DV letters through the Post Office certified mail with return receipt.Fifth, dispute the listings on your reports with all the bureaus about a weeksafter you mail the DV.Finally, keep on reading the site which you wait for responses. What should i do??I'm also curious about the fact you say you were 17 at the time. Was this done without a co-sign of any type? Im still trying to figure out the account open date but cannot find it. I know the acount was open the same month i turned 18 but i think it was open before my bday. You can try calling the CRA as they might have it in suppressed data somewhere. Regardless, you won't find it until you start asking -- even if that means you ask LVNV (who probably doesn't have it anyway and could care less).You are not sure whether or not you were 17 when the account was opened. I understand. Don't you think 17 years of age is old enough to be an adult and take responsibility? I'm not challenging the legal argument -- something about your story just feels wrong.The legal argument will succeed or fail based on the laws of your state. I now know better on how to handle my credit and finances. I was just trying to figure it out cause, i guess i was trying to get out of it.(which i know is wrong but cant afford to have it on my report and cant afford to pay it, unless they are willing to work with me.I just recieved a letter from them offering a 65% settlement, but if they are willing to come down I might be able to borrow the money. I know people who are 40 and act like they are 14. Society has always drawn a line to separate adults from children. The line is murky and moves around depending on the issue at hand. At 18 you can vote and enlist in the military. If you are 17, a parent must give permission to enlist. At 21 you can drink. At 16 get a drivers license. At 14 be tried as an adult in criminal court. All those can be moved around some depending on the laws of your state -- I think there is one state where you can get married at 15 if a parent consents. It does not make rhyme or reason. I don't have any moral objections to a person who uses the law to a selfish end. That is why we have laws and in the end we all act in our own self-interest. You are the only one who can decide what fits your values -- others can advise or criticize but it is your responsibility -- so decide for yourself.
