Coming Clean Posted January 22, 2008 Report Share Posted January 22, 2008 I have tried twice with the debt validation letter to two of my creditors with no response from either one and no removal from my credit report. I also wrote to the credit reporting agencies and still no removal.What is my next move? Neither one of these debts are valid. I'm trying to get a first time home mortgage and want the best rate possible. These items are dragging my score down.Should I put a note in my credit reports about them?Help!! If they were untimely, meaning they were not sent within 30 days of the initial collection letter, then they re not required to respond to you according to the FDCPA. You should check your state's laws governing collection activities. There may be a law that they are required to respond, TX is a good example of a state with this provision... Good luck. Coming Clean Posted January 22, 2008 Author Report Share Posted January 22, 2008 One is from an online college in which I withdrew in time not to charged and can prove it (which I did)And the other occurred because someone in my apartment complex recieved my mail and ordered items in my name. I proved it to the complany where the merchandise was bought from, and they were satisfied. The first should be simple to remove by contacting the OC and requesting an investigation. Disputing with the CRA's or DVing a CA on this will get you nowhere.The other issue is ID Theft/Fraud. This can be easily addressed by sending the CRA's documentation to support your claim. You can find the required list in the FCRA Title 15 USC 1681c-2, Subsection 605B. Notice that you can dispute the entire account or specific transaction(s), which applies in your case. The definition of, and reason for, a proper ID Theft report can be found in 1681a, Subsection 603(q). There is a sticky at the top of the page. All parties involved rightfully ignore your claims without these docs. When submitted, this should be no problem.
