Robert Nashville/Savannah Posted January 24, 2008 Report Share Posted January 24, 2008 Unless your state law extends FDCPA protections to include original creditors, then no, a C&D letter will not stop them from calling you because the FDCPA does not apply to original creditors.Not that you asked, but it's generally NOT a good idea to cut yourself off from communicating with the original creditor anyway - it's generally to your benefit to work out a solution with the OC rather than ignor them and let the matter escalate (which it almost will).I am assuming, of course, that they aren't engaging in harassment and other such tactics - FDCPA may not apply but telephone regulations may well apply in that case.If you really don't want to talk to them then about the only thing you can do is not answer the phone.
