I have a couple of questions and if some one has the time would sure appreciate some info. Here goes1)I have a chapter 7 that was dismissed in 04/23/2004. My problem is this- I lost a house in foreclosure and filed BK. The home at times keeps refering back to "In Foreclosure" and " 180 Days Late" It seems that as soon as I get is changed to "Included in Bankruptcy" within a couple of weeks it goes back to "In Foreclosure" I have disputed it on line many times and sometimes it comes back as being reported accurately (which it is not, "In Foreclosure"). This time I sent proof of BK and of discharge along with F1 (sp?). Equifax is reporting it correctly as of 1/24/2007. The other 2 are not. I have dealt with Flagstar (the bank that took back the home), and they assure me that they will be reporting it as "Included In BK". What a JOKE! I guess the question is, what is my next step? I have only recieved 1 certafied recipt back so far.2) Having troubles dealing with Experian. I was only allowed to dispute on line once and now they ae asking for proof. I sent proof and have not gotten any response as of the 24 of January. Certafied letters were sent on the 3rd of January. momof5 Posted January 26, 2008 Report Share Posted January 26, 2008 OK, here is what *I* did in a situation where I would dispute the listing....it would be changed for the better and then revert (because of their automated system).I would send them an ITS for violations of the FCRA. Tell them that you have multiple copies of your CR and no matter how many times you dispute it and get it corrected, it reverts back to an inaccurate trade line. I would include photocopies of the proof. (I named as defendants the OC, ALL the CRAs [because it flips constantly, they 'knew or should have known it was inaccurate!"] and fired it to them via fax! I was called within the hour by EQ, EX and the OC!!!!]Inform them that this is sufficient proof that they cannot verify what is or is not accurate and you expect a deletion immediately or you will sue...and that this violation is willful since it keeps happening!For me, their CRA-type folks (at the OC) called me. He was trying to disuade me from suing. I told him...."fixing is now doesn't matter. It is like closing the barn door after the horse has already gotten out! I have all I need to win. The ONLY thing that would make me happy is deletion!!!" So what did he do? Made it a closed PAA account!!!! Ok, I'll forgive them! LOLBe strong and firm.
