momof5
Establish that this is NOT him and NOT his and mail it back with "close this acct and ensure it is not on his CR!"
cheyenne52883
OK. Thanks. I just wanted to make sure it was as simple as that.... Don't wanna mess anything up at this point...This information was provided from the collection agency... If the collection agency and the OC are listed, can I forward this info to the CB's to have BOTH removed?
willingtocope
The CRAs (CBs) are not going to take your word for it. Don't bother. When you say the application is not his...how do you know? Someone else's name and information? SS#?If so...you might also point out in your letter to the CA that are guilty of divulging infomation about that other person's debt to a 3rd party, which is a serious violation of the FDCPA. (No harm to you...but serious harm to the other person).
cheyenne52883
The sent an "application" which just looks like a print out of an online application screen with his name, address, SS#, bday and cell phone. Then there are statements which have a different name, ss#, address, etc.
kb9tbq
Yeah you want to send a copy of that application back to them with a letter explaining that that is not him and to take care of this matter. To either send back the right application or remove this off of his credit report.
willingtocope
Did he indeed apply for this? Are you claiming that they fabricated the app?(The statements do violate the FDCPA, but, like I said...it hurts the other person, not you guys). cheyenne52883
He said he never applied for this card.
willingtocope
He said he never applied for this card.In that case, you might want to put together a nice little "intent to sue" for them...pointing out their fabrication and pointing out that their other evidence does not apply. You could make some money off this...
cheyenne52883
But what if it turns out that he had applied for this card and forgot? What if they can provide the correct information? If I threaten to sue and then they pull the info out of their A$$ will that cause more problems? kb9tbq
You can also fill out an ID Theft affidavit that this is not your account, is it showing on the credit report? I would dispute it with the credit reporting agency, activate a fraud alert and fill out a police report and provide them with the info you have on this account. Copies onlyTell the collection agency that you want to fill out an affidavit that this is not his account.
cheyenne52883
It is showing on the credit report. Both the OC and this collection account.
cheyenne52883
I sent some emails to the CB's just to see if I might get a response. Equifax replied almost immediately. They stated that the CA sent 32 pages not 11 like I had scanned and sent to them and that the company admitted to sending the information for the other person.I replied back saying, no, only 11 pages were received. We'll see if they respond to that or not. cheyenne52883
Equifax replied back and said "Please provide us wuth your fax number and I will have the collection agency fax over the pages you appear to be missing"I gave them my fax and so far I have recieved nothing... I only recieved 11 pages, not 32 so I assume they don't have the information and plan on simply stalling the situation..Do you think I should email Equifax back at the end of the day if I don't recieve anything? wahoo238
Based on the info you have said here I would fill out an afidavit of fraud sign/notarize make copies and send to CA and CRA, would also follow with a police report.
